Play Smart Technology LLC - League Challenge

1. Acceptance of Terms

By accessing or using League Challenge ("the Service"), a product of Play Smart Technology LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms apply to all users of the Service, including beta users, registered users, and visitors to our website.

2. Description of Service

League Challenge is a web-based application that enhances fantasy football leagues by providing:

  • Weekly mini-games and challenges for ESPN fantasy football leagues
  • Real-time leaderboards and analytics
  • League engagement tools and features
  • Integration with ESPN fantasy sports data

The Service is currently in beta and is provided free of charge to the first 100 users.

3. Account Registration

To use certain features of the Service, you must register for an account using Google OAuth authentication. You agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your account credentials
  • Promptly update your account information as needed
  • Be responsible for all activities that occur under your account

You must be at least 13 years old to create an account and use the Service.

4. ESPN Integration and Data Usage

Our Service integrates with ESPN fantasy football leagues. By connecting your ESPN league, you acknowledge that:

  • You have the authority to connect your league to our Service
  • We will access your league's data including team names, scores, and player statistics
  • We may cache this data to provide our Service effectively
  • You remain responsible for compliance with ESPN's terms of service

We only access data necessary to provide our Service and do not modify your ESPN league settings.

5. User Conduct

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe on the rights of others
  • Transmit harmful, offensive, or inappropriate content
  • Attempt to gain unauthorized access to our systems
  • Interfere with the proper functioning of the Service
  • Use the Service for commercial purposes without our consent

We reserve the right to suspend or terminate accounts that violate these conduct guidelines.

6. Beta Program Terms

League Challenge is currently offered as a beta service. Beta users understand that:

  • The Service may contain bugs, errors, or incomplete features
  • Service availability is not guaranteed
  • Features may change or be discontinued without notice
  • Free access is limited to the first 100 users
  • We may collect feedback to improve the Service

Beta access may be revoked at any time at our discretion.

7. Privacy and Data Protection

We collect and process data in accordance with our Privacy Policy. By using the Service, you consent to:

  • Collection of your Google account information (email, name, profile picture)
  • Storage of your ESPN league data for Service functionality
  • Collection of usage analytics to improve the Service
  • Processing of feedback you voluntarily provide

We do not sell or share your personal data with third parties except as necessary to provide the Service.

8. Intellectual Property

The Service, including its design, functionality, and content, is owned by Play Smart Technology LLC and is protected by intellectual property laws. You are granted a limited, non-exclusive license to use the Service for personal, non-commercial purposes.

ESPN and fantasy football data remain the property of their respective owners. We do not claim ownership of your league data.

9. Service Availability

We strive to maintain high service availability but cannot guarantee uninterrupted access. The Service may be temporarily unavailable due to:

  • Scheduled maintenance
  • Technical difficulties
  • Third-party service outages (including ESPN)
  • Force majeure events

We will provide reasonable notice of planned maintenance when possible.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PLAY SMART TECHNOLOGY LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claims related to the Service shall not exceed the amount paid by you for the Service in the twelve months preceding the claim.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be error-free, secure, or continuously available.

12. Termination

Either party may terminate your access to the Service at any time. We may terminate or suspend accounts that violate these Terms or for any other reason at our discretion.

Upon termination, your right to use the Service ceases immediately, and we may delete your account data.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes through the Service or via email. Continued use of the Service after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the jurisdiction where Play Smart Technology LLC is incorporated, without regard to conflict of law principles.
